A divided Supreme Court has dismissed as premature a challenge to President Donald Trump’s plan to exclude people living in the country illegally from the population count used to allot states seats in the House of Representatives.
The court’s decision Friday, led by its conservative justices, is not a final ruling on the matter and, while it allows Trump to pursue the plan for now, it’s not clear whether he will receive final numbers from the Census Bureau before he leaves office next month.
If the president still has not received final census numbers by the time Joe Biden takes office Jan. 20, Trump’s plan will be effectively dead because Biden is extremely unlikely to pursue it. It’s also possible the Biden administration would take steps to try to reverse decisions made under Trump.
For now, though, the high court said it was too soon to rule on the legality of Trump’s plan because it’s not yet clear how many people he would seek to exclude and whether the division of House seats would be affected.
The court said in an unsigned opinion that “we express no view on the merits of the constitutional and related statutory claims presented. We hold only that they are not suitable for adjudication at this time.” At least five of the court’s six conservative justices had to join the opinion to make a majority on the nine-member court.
The three liberal justices dissented, saying the effort to exclude people in the country from the population for divvying up House seats is unlawful.
“I believe this Court should say so,” Justice Stephen Breyer wrote, joined by Justices Elena Kagan and Sonia Sotomayor.
It’s not clear that Friday’s decision will have much practical effect. Documents leaked to the House committee that oversees the Census Bureau suggest the apportionment numbers won’t be ready until after Jan. 20, when Trump leaves office and Biden becomes president. The Census Bureau has acknowledged the discovery of data irregularities in recent weeks that put the Dec. 31 deadline in federal law for transmitting numbers to the president in jeopardy.
Dale Ho, the American Civil Liberties Union lawyer who argued the case for the challengers, said the decision was about the timing of the case, not whether the plan complies with federal law.
“This ruling does not authorize President Trump’s goal of excluding undocumented immigrants from the census count used to apportion the House of Representatives. The legal mandate is clear ? every single person counts in the census, and every single person is represented in Congress. If this policy is ever actually implemented, we’ll be right back in court challenging it,” Ho said.
No president has tried to do what Trump outlined in a memo in July ? remove millions of noncitizens from the once-a-decade head count of the U.S. population that determines how many seats each state gets in the House of Representatives, as well as the allocation of some federal funding.
States with large populations of people who are in the country illegally could lose seats in the House under Trump’s plan, and the president signaled in his memo that punishing states that “encourage illegal aliens” is one reason he issued it.
By the administration’s estimate, California could lose two to three House seats if people living in the country illegally were excluded based on what the administration said are more than 2 million such California residents.
His administration has defended his authority to exclude at least some people living in the country illegally, including perhaps people who are in immigration detention or those who have been ordered to leave the country.
But during arguments last month, acting Solicitor General Jeffrey Wall, Trump’s top Supreme Court lawyer, would not rule out larger categories of immigrants, including those who have protection from deportation under the DACA program.

President Donald Trump has repeatedly said there’s one place he wants to determine the outcome of the presidential election: the U.S. Supreme Court. But he may have a difficult time ever getting there.
Over the last two days, Trump has leaned in to the idea that the high court should get involved in the election as it did in 2000. Then, the court effectively settled the contested election for President George W. Bush in a 5-4 decision that split the court’s liberals and conservatives.
Today, six members of the court are conservatives, including three nominated by Trump. But the outcome of this year’s election seemed to be shaping up very differently from 2000, when Florida’s electoral votes delivered the presidency to George W. Bush.
Then, Bush led in Florida and went to court to stop a recount. Trump, for his part, has suggested a strategy that would focus on multiple states where the winning margins appear to be slim. But he might have to persuade the Supreme Court to set aside votes in two or more states to prevent Joe Biden from becoming president.
Chief Justice John Roberts, for his part, is not likely to want the election to come down to himself and his colleagues. Roberts, who was not on the court for Bush v. Gore in 2000 but was a lawyer for Bush, has often tried to distance the court from the political branches of government and the politics he thinks could hurt the court’s reputation.
It’s also not clear what legal issues might cause the justices to step in. Trump has made repeated, unsubstantiated claims of election fraud. Lawsuits filed by his campaign so far have been small-scale efforts unlikely to affect many votes, and some already have been dismissed.
Still, Trump has focused on the high court. In the early morning hours following Election Day he said: “We’ll be going to the U.S. Supreme Court — we want all voting to stop.” And on Thursday, as Biden inched closer to the 270 Electoral College votes needed to win the White House, Trump again told Americans, “It’s going to end up, perhaps, at the highest court in the land, we’ll see.” On Twitter too he urged, “U.S. Supreme Court should decide!”
There is currently one election case at the Supreme Court and it involves a Republican appeal to exclude ballots that arrived after Election Day in the battleground state of Pennsylvania. But whether or not those ballots ultimately are counted seems unlikely to affect who gets the state’s electoral votes.
Biden opened a narrow lead over Trump on Friday, and any additional mail-in votes probably would help Biden, not the president.
Still, Trump’s campaign is currently trying to intervene in the case, an appeal of a decision by Pennsylvania’s highest court to allow three extra days for the receipt and counting of mailed ballots. Because the case is ongoing, the state’s top election official has directed that the small number of ballots that arrived in that window, before 5 p.m. Friday, be separated but counted. Republicans on Friday asked for a high court order ensuring the ballots are separated, and Justice Samuel Alito, acting on his own, agreed, saying he was motivated in part by the Republicans’ assertion that they can’t be sure elections officials are complying with guidance.

The Supreme Court on Wednesday said it would not grant a quick, pre-election review to a new Republican appeal to exclude absentee ballots received after Election Day in the presidential battleground state of Pennsylvania, although it remained unclear whether those ballots will ultimately be counted. The court’s order left open the possibility that the justices could take up and decide after the election whether a three-day extension to receive and count absentee ballots ordered by Pennsylvania’s high court was proper.
The issue would take on enormous importance if Pennsylvania turns out to be the crucial state in next week’s election and the votes received between Nov. 3 and Nov. 6 are potentially decisive. The Supreme Court ruled hours after Pennsylvania’s Department of State agreed to segregate ballots received in the mail after polls close on Tuesday and before 5 p.m. on Nov. 6. President Donald Trump’s campaign suggested that those ballots will never be counted.
“We secured a huge victory when the Pennsylvania Secretary of State saw the writing on the wall and voluntarily complied with our injunction request, segregating ballots received after the Nov. 3 deadline to ensure they will not be counted until the Supreme Court rules on our petition,” Justin Clark, a deputy campaign manager, said in an interview. The court, Clark said, deferred “the most important issue in the case, which is whether state courts can change the time, place and manner of elections, contrary to the rules adopted by the Legislature.”
Pennsylvania’s Department of State could not immediately say Wednesday night whether it would revise its guidance to the counties about whether to count those ballots. The Alliance for Retired Americans, which had sued in Pennsylvania state courts for an extended deadline, said the ruling means that ballots arriving during the three-day period after Election Day will be counted. “This is an enormous victory for all Pennsylvania voters, especially seniors who should not have to put their health at risk during the pandemic in order to cast a ballot that will be counted,” Richard Fiesta, the alliance’s executive director, said in a statement.
New Justice Amy Coney Barrett did not take part in the vote “because of the need for a prompt resolution of it and because she has not had time to fully review the parties’ filings,” court spokeswoman Kathy Arberg said in an email. Justice Samuel Alito, writing for three justices, indicated he would support the high court’s eventual review of the issue. But, he wrote, “I reluctantly conclude that there is simply not enough time at this late date to decide the question before the election.” Last week, the justices divided 4-4, a tie vote that allowed the three-day extension ordered by the Pennsylvania Supreme Court to remain in effect.

When Texas’ attorney general needed someone to probe a claim by one of his wealthy political donors alleging crimes by the FBI, he turned to a junior Houston lawyer with no prosecutorial experience, a modest criminal defense practice and ties to the donor’s defense attorney.
Republican Attorney General Ken Paxton said his own staff had been working to “impede the investigation” into real estate developer Nate Paul’s allegations against federal law enforcement. He explained that’s why he brought in an “outside independent prosecutor” to look into the case.
The move led Paxton’s top deputies last week to accuse him of bribery and abuse of office. It’s unclear what underlies these allegations, and what would have recommended Brandon Cammack to handle the fraught investigation.
But Cammack’s contract shows he’s not independent of Paxton. And social media posts show Cammack and Paul’s defense attorney, Michael Wynne, are connected on Facebook and are both part of a Houston civics organization. The lawyers didn’t respond to questions about their connections.
Paxton’s choice of outside counsel raises further questions about a decision that has deepened political, and possibly legal, trouble for the attorney general. Paxton rose to national prominence during his time in office but also has spent most of it maintaining his innocence in the face of a felony indictment.
Cammack told Paxton’s staff in an early September email that “my firm does not have any conflicts of interest with regards to this investigation.” Paxton office did not respond to questions about the lawyer’s selection. The attorney general has resisted calls for his resignation and cast blame on “rogue employees and their false allegations.”
Cammack’s father said he thinks his son is being set up as a “scapegoat.”
“I think Paxton was looking for someone that could get beat up on. I think he might have been looking for an easy mark,” Samuel Cammack III said. “Brandon doesn’t even have the ability to do what Paxton was asking him to do.”
A 2015 University of Houston Law Center graduate, Cammack is being paid $300 an hour to look into the complaint from Paul, who gave Paxton a $25,000 campaign contribution in 2018. It’s unclear what the developer has alleged, but his claims came to light a year after the FBI searched his home and office.

A Chinese scientist charged with visa fraud after authorities said she concealed her military ties to China in order to work in the U.S. made her first appearance Monday in federal court by video.
Juan Tang, 37, was appointed a federal public defender and U.S. Magistrate Judge Deborah Barnes ordered Tang to remain in custody, saying she is a flight risk, while her attorney prepares an argument to allow her release on bail.
The Justice Department last week announced charges against Tang and three other scientists living in the U.S., saying they lied about their status as members of China’s People’s Liberation Army. All were charged with visa fraud.
Prosecutors said Tang lied about her military ties in a visa application last October as she prepared to work at the University of California, Davis and again during an FBI interview in June. Agents found photos of Tang dressed in military uniform and reviewed articles in China identifying her military affiliation, prosecutors said.
Prosecutors said Tang sought refuge at the Chinese consulate in San Francisco after speaking with agents in June. U.S. marshals arrested her Friday and booked her into Sacramento County Jail, where she remains.
Heather Williams, a federal defender, said its common practice for people to seek help from their consulate when dealing with law enforcement abroad, and doing so did not make Tang guilty of anything, she said. Williams added that U.S. agents took Tang's passport, forcing her young daughter to travel to China alone.

More than 150 Minneapolis police officers are filing work-related disability claims after the death of George Floyd and ensuing unrest, with about three-quarters citing post-traumatic stress disorder as the reason for their planned departures, according to an attorney representing the officers.
Their duty disability claims, which will take months to process, come as the city is seeing an increase in violent crime and while city leaders push a proposal to replace the Minneapolis Police Department with a new agency that they say would have a more holistic approach.
While Floyd’s death in May and the unrest that followed are not the direct cause of many of the disability requests, attorney Ron Meuser said, those events and what Meuser called a lack of support from city leadership were a breaking point for many who had been struggling with PTSD from years on the job. Duty disability means the officer was disabled while engaged in inherently dangerous acts specific to the job.
“Following the George Floyd incident, unfortunately it became too much and as a result they were unable to, and are unable to, continue on and move forward,” Meuser said. “They feel totally and utterly abandoned.”
He said many officers he represents were at a precinct that police abandoned as people were breaking in during the unrest. Some officers feared they wouldn’t make it home, he said, and wrote final notes to loved ones. People in the crowd ultimately set fire to the building.
Mayor Jacob Frey issued a statement saying that COVID-19 and unrest following Floyd’s death tested the community and officers in profound ways. He said cities need resources to reflect the realities on the ground.
“In the meantime, I am committed to supporting those officers committed to carrying out their oath to serve and protect the people of Minneapolis during a challenging time for our city,” he said.
Meuser said in recent weeks, 150 officers have retained his office for help in filing for duty disability benefits through the state’s Public Employment Retirement Association, or PERA. So far, 75 of them have already left the job, he said.
Police spokesman John Elder questioned Meuser’s figure of 150, though he does expect an increase in departures. The department currently has about 850 officers and will adjust staffing to ensure it can do its job, he said.
The city said it has received 17 PTSD workers compensation claims in the last month, but when it comes to PERA duty disability, officers are not obligated to notify the Police Department that an application was submitted. Meuser said the city isn’t being transparent about departures, and the numbers it sees will lag as PERA benefits take months to process.
